From time to time a business' needs change regarding the size, type, and configuration of the space needed to conduct it's operations. Ideally, the business has grown and needs more space. When that happens, it isn't unusual for a business to lease more space from the same landlord. Even though the landlord incurs a temporary rent loss from the vacation of the smaller space, he benefits from having increased income on the larger space and a chance to re-lease the smaller. Unfortunately, business downturns can force a business to look for smaller space as a way of reducing operating expenses. Depending on the circumstances, the landlord or property owner may not be interested in helping solve the problem through rent abatements, offering smaller space, or other possible solutions. Under adverse circumstances, disputes frequently develop. If unresolved, they can lead to time consuming, expensive legal proceedings. Establishing open and neutral communications between the landlord and tenant is critical to the lease resolution process. While commercial real estate practices and customs vary by region, many legitimate tenant/landlord disputes can be satisfactorily settled through well intended professional negotiation. |
